This Privacy & Confidentiality Notice explains how Messy Minds Collective collects, uses, stores, and discloses personal information, and how you can access that information.

Messy Minds Collective is committed to protecting your privacy and handling personal information in a respectful, transparent, and lawful way.

This notice is provided in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

OUR LEGAL RESPONSIBILITIES

Under Australian privacy law, Messy Minds Collective is required to:

Take reasonable steps to protect your personal information

Use personal information only for its intended purpose

Ensure information is accurate, up to date, and stored securely

Provide access to personal information upon request (subject to legal limits)

We may update this Privacy Notice from time to time. The most current version will always apply and will be available upon request or via our website.

WHAT INFORMATION WE COLLECT

As part of providing ADHD coaching services, we may collect personal information such as:

Your name, contact details, and billing information

Intake forms and coaching goals

Session notes relevant to coaching support

Communication records (email, messages, scheduling)

Messy Minds Collective does not provide medical or therapeutic services and does not collect medical records in the way health practitioners do.

HOW YOUR INFORMATION IS USED

Your personal information is used only for purposes directly related to coaching services, including:

Delivering coaching sessions

Managing bookings and payments

Communicating with you about services

Improving service delivery

Your information will not be sold, shared, or disclosed without your consent, except where required or permitted by law.

DISCLOSURE OF INFORMATION

Your information may be disclosed without consent only in limited circumstances, including:

Where required by Australian law or court order

Where there is a serious threat to life, health, or safety

Where mandatory reporting obligations apply

For administrative or business operations (e.g. secure booking or payment systems)

Where possible, only the minimum necessary information will be disclosed.

CONFIDENTIALITY LIMITS

Coaching confidentiality is not the same as medical or legal privilege.

Confidentiality may be broken if:

There is a serious risk of harm to you or others

Disclosure is required by law

Mandatory reporting obligations apply (e.g. child safety)

ACCESS TO YOUR INFORMATION

You have the right to:

Request access to personal information held about you

Request corrections if information is inaccurate or incomplete

Requests must be made in writing. We will respond within a reasonable timeframe (usually within 30 days).

In some circumstances, access may be limited or refused in accordance with the Privacy Act. If access is refused, reasons will be provided in writing.

STORAGE & SECURITY

Messy Minds Collective takes reasonable steps to protect your information from misuse, loss, unauthorised access, or disclosure.

Information may be stored:

Electronically (secure systems and devices)

In limited paper form (securely stored)

NOTICE OF PRIVACY PRACTICES UNDER HIPAA

The purpose of this notice is to inform you about how medical information about you may be used and disclosed, as well as how to get access to that

information. Please read it thoroughly and will full attention.

Our Legal Duty

According to the law, I/we (change to fit you) must:

• Maintain the privacy of your Protected Health Information (PHI).

• Provide you with information about your legal rights and our privacy practices.

Additionally, we are allowed to:

• Amend our privacy practices and this notice at any time, as long as the changes are permitted by law.

• We will, however, update this notice before changing our privacy practices.

Your Protected Health Information

Your medical information will not be used or disclosed without your written permission, unless required by law. By writing to us, you may revoke your

authorization. Using or disclosing your information for treatment, payment, or health-related operations does not require your consent.

Your PHI may be used and disclosed for treatment and billing purposes without your consent. Information may be given to office staff, insurance

providers, business associates, etc., when appropriate.

Other Disclosures

• If you need emergency treatment, your consent is not necessary if I attempt to obtain it afterward.

• When compelled by federal, state, or law enforcement officials to use or disclose your PHI, I may do so without your consent

• Your personal information may be disclosed if it coincides with the Mandatory Reporting Laws of my state, which normally refer to threats

to someone's safety, health, or welfare.

What Rights Do You Have Over Your PHI?

• You are entitled to see and obtain copies of your protected health information. All requests must be in writing, and responses are provided within (TIME PERIOD). In place of a full report, you may receive a summary. You will be charged ______ per page for copies of your PHI.

• If you request a list of the disclosures I have made, it will be provided within 60 days. Records of disclosure are kept for six years excluding law enforcement records or items for which consent has already been given. PHI you provided is subject to amendment under your consent. Any information that you think needs to be corrected or added can be requested by you. You must submit your request and the reason for it in writing. You may receive a written denial if I conclude that the PHI is:

• Complete and accurate

• Information that cannot be disclosed

• Not included in my records

• Authored by someone else.

Privacy Complaints

You can reach me directly by phone at (YOUR PHONE #), by email at (YOUR EMAIL ADDRESS), or by mail at (YOUR ADDRESS). It is required to provide this information to clients receiving psychotherapy under AB 630, Chapter 229 of the Statutes of 2019. The Notice of Privacy Practices (NPP) requires me/us (YOU CHOOSE) to state that you are entitled to notification in the event of a breach.
